1. DEFINITIONS
Editorial Content: Refers to all the information made available to Users by EVOCLIC.
Personal Data: Refers to personal information:
- that the User has registered when subscribing to the Services offered by EVOCLIC (namely the creation and management of boards: scoreboards/leaderboards/counters/goal trackers)
- and/or provided in the context of using the Services.
Intellectual Property Rights: Refers to trademarks, domain names, copyrights, designs, patents, database rights, or any other intellectual property rights utilized by EVOCLIC and necessary for its service provider activities.
Form: Refers to the registration or information request form that the User can complete to benefit from certain Services from EVOCLIC after reading these Terms of Service.
Hyperlink: Refers to the referencing system materialized by a word, icon, or logo that allows, by a mouse click, to switch from one document to another on the same website or from one page of a website to another page of a different website.
Services and Offerings: Refers to all the Services, including Specific Services and Options, offered by EVOCLIC to Users through its website Scoreleader.com.
Application: Refers to the technical solution named ScoreLeader and provided by EVOCLIC.
Site: Refers to the website made available to the public through the Internet at the URL addresses https://scoreleader.com.
User: Also called a member on the Site, refers to any natural person, of legal age and capacity, using the Services offered by EVOCLIC. This person is considered a customer after placing an order or when placing an order on the Site.
Participant: Refers to an entity present in a board.
2. PURPOSE
These Terms of Service aim to define the terms and conditions under which EVOCLIC provides Services to Users. Any use or purchase of any of the Services offered by EVOCLIC shall be in accordance with these Terms of Service.
3. ACCEPTANCE OF THESE TERMS OF SERVICE
The User declares to have read and expressly and unconditionally accepted these Terms of Service in effect on the day of accessing the website and subscribing to the Services offered by EVOCLIC.
EVOCLIC reserves the right to modify all or part of these Terms of Service at any time. Therefore, it is the User’s responsibility to regularly refer to the latest version of the Terms of Service, available at all times on the Scoreleader.com Site. Any new use of the Services after modifying the Terms of Service shall constitute full and unreserved acceptance by the User of the new Terms of Service.
4. SERVICES AND OFFERINGS
4.1 Definitions of Services and Offerings
Through its Scoreleader.com Site, EVOCLIC offers Services and Offerings that allow the creation and management of boards.
EVOCLIC provides the User with access to an online tool for creating boards. The User has features for managing their boards and information for tracking their boards.
4.2 Access Conditions
Using the Services requires the User to follow a registration procedure in which they must provide their contact details. The User commits to ensuring that the information provided, including personal information, is accurate, complete, and up to date and to make the necessary changes to this end. The User’s email must, in particular, be valid and regularly checked.
The User declares to have read and expressly accepted the Terms of Service in effect on the day of subscription to the Services by clicking on the box titled “I accept the Terms of Service.” Any acceptance expressed by the User by a click is equivalent to their handwritten signature. By performing this click, the User is deemed to have irrevocably agreed.
4.3 Prices of Services and Offerings
The prices applicable to the User for the Services are those indicated on the Site at the time the User confirms their order.
The prices are in dollars and are exclusive of taxes. Prices may be subject to VAT depending on the User’s country of residence.
EVOCLIC reserves the right to change its prices without notice. Orders placed before the change will not be affected.
4.4 Ordering a Service or Offering
The Services and Offerings available for sale by EVOCLIC are presented on the Scoreleader.com Site.
Before confirming an order and its payment, the User can modify or cancel their order.
The User guarantees the following:
- They are authorized to use the bank card for payment of their order, as well as any other payment solution made available on the Scoreleader.com Site and used for the payment of their order.
- The available funds, via the chosen payment solution, are sufficient to pay for EVOCLIC’s Services and Offerings.
- Acceptance of the Terms of Service.
EVOCLIC will automatically or manually provide an invoice to the User (Client) on the Site.
The information recorded by EVOCLIC is the only valid evidence regarding all transactions between EVOCLIC and the User.
4.5 Paying for a Service or Offering
The order payment can be securely made by credit card and any other payment solution made available on the Scoreleader.com site.
The bank chosen by EVOCLIC may refuse a transaction if fraud is suspected or for any other reason. The User must provide the bank with all the necessary information to pay for their order, including the credit card number, expiration date, and security code.
If the bank refuses, the order will be canceled, and the User will be informed.
4.6 Order Confirmation by EVOCLIC
The User’s order will be validated and processed after payment and upon confirmation by EVOCLIC. The order confirmation is made on the Scoreleader.com Site interface.
EVOCLIC may refuse an order in the event of a dispute or failure by the User to comply with these Terms of Service. EVOCLIC may also refuse to fulfill an order that violates applicable laws or for any other reason deemed valid, at its sole discretion.
4.7 Delivery of Services and Offerings
The delivery of Services and Offerings will take place immediately.
4.8 Order Refund
If the order cannot be fulfilled, EVOCLIC reserves the right to refund or not refund the service amount, considering the time possibly spent by the company.
Each refund acceptance is at EVOCLIC’s discretion.
5. ACCESSIBILITY TO SERVICES
EVOCLIC strives to keep its website accessible 24/7 but may interrupt access for maintenance and upgrades or any other reason, especially technical reasons.
EVOCLIC is not responsible for these interruptions or their consequences for the User.
EVOCLIC reserves the right to refuse access to any or all parts of the Scoreleader.com Site to any User unilaterally and without prior notification, particularly in the event of a clear violation of these Terms of Service.
The User acknowledges that EVOCLIC cannot be held responsible for any direct or indirect damage resulting from the removal of the User’s access to the Scoreleader.com Site.
6. INTELLECTUAL PROPERTY RIGHTS
The User acknowledges that EVOCLIC is the sole owner of the Intellectual Property Rights related to the Scoreleader.com Site and the Editorial Content.
No provision of these Terms of Service shall be interpreted as granting the User a license on the Intellectual Property Rights owned or exclusively exploited by EVOCLIC.
EVOCLIC only grants permission to view its Editorial Content for personal and private use, excluding any public viewing or dissemination.
Therefore, any unauthorized representation, reproduction, or extraction of the Editorial Content or its website, as well as any other Intellectual Property Right, is strictly prohibited and may result in legal proceedings.

As such, EVOCLIC cannot be held responsible for any damages resulting from the User’s use of the Editorial Content for any purpose.
The Scoreleader.com Site contains Hyperlinks to websites managed by third parties. EVOCLIC cannot control these sites or assume responsibility for their content. The inclusion of these links does not imply EVOCLIC’s approval of the content on these sites. EVOCLIC cannot be held responsible for the content of these sites, and the fact that these sites are referenced on the Scoreleader.com Site does not engage EVOCLIC’s responsibility.
Therefore, EVOCLIC does not guarantee:
- The truthfulness, timeliness, quality, completeness, and comprehensiveness of the content of indexed websites;
- The relevance and completeness of indexed websites;
- The accessibility and operation difficulties of these websites.
The User acknowledges that:
- The use of Services is at their own risk, particularly regarding downloading data, files, or software that could damage their computer. EVOCLIC cannot be held liable for any data loss, viruses, computer bugs, or damage to the User’s computer;
- EVOCLIC does not guarantee the suitability of the Services offered to the User’s expectations;
- EVOCLIC does not guarantee the quality and/or legality or compliance with the law of non-EVOCLIC-created content, especially content and opinions expressed by the User or disseminated on external websites accessible through a Hyperlink;
- EVOCLIC cannot be held liable for the dissemination of data by the User in violation of rights, particularly proprietary rights, held by third parties;
- EVOCLIC cannot be held responsible for damages resulting from technical causes, including the unavailability of its website and boards, or any defects affecting their functioning;
- EVOCLIC cannot be held responsible for direct or indirect damages such as financial losses, loss of profits, or any disruption of any kind resulting from the use or inability to use the Services offered.
Additionally, the User indemnifies EVOCLIC against any claims or actions brought against it for any reason and, more generally, in connection with the entry of data or information.
The creator of a board is solely responsible for complying with their legal obligations regarding the processing of personal data and for any necessary formalities.
The User acknowledges that the creator of a board is solely responsible for the proper conduct of their operation and for fulfilling their commitments to their participants.
Therefore, the User fully releases EVOCLIC in the event of disputes with participants or any other party.
8. ACCEPTANCE OF INTERNET RISKS
The User declares to be well aware of the Internet, its characteristics, and its limitations, and in particular acknowledges:
- That the Internet is an open network not controlled by EVOCLIC and that data exchanges on the Internet only have relative reliability and are not protected against possible misappropriation or hacking;
- That the communication of sensitive information by the User is therefore done at their own risk;
- That they are aware of the nature of the Internet network, particularly its technical performance and response times, for consulting, querying, or transferring data.
EVOCLIC cannot guarantee that the information exchanged will not be intercepted by third parties and that the confidentiality of exchanges will be guaranteed.
EVOCLIC informs the User of the existence of rules and customs in effect on the Internet known as Netiquette, as well as various codes of conduct, including the Internet Charter, accessible online.
9. PERSONAL DATA – PRIVACY RULES
EVOCLIC collects information provided by Users and their Participants:
- Through a Form or directly sent by Users to better understand them and provide them with EVOCLIC Services;
Aware that collecting and processing Personal Data on the Internet must respect individuals’ fundamental rights, EVOCLIC reminds that each User and each Participant has rights over their Personal Data.
The User and Participants can exercise the right to access, rectify, delete data, limit processing, data portability, object to the processing, and withdraw consent.
The User or Participant can exercise these rights at any time by sending an email with our contact form. A maximum period of 15 days is required before the User’s request is taken into account.
EVOCLIC does not sell or transmit personal contact details to third parties without your consent, except in the unlikely event that:
- It is required by law or in response to a court order or equivalent
- It is expressly necessary to prevent any loss or damage that may be caused to our company’s property
- It is necessary to obtain legal advice for or during legal proceedings in which EVOCLIC is a party or witness.

If it is no longer necessary to retain the data, the User can request at any time the immediate deletion of personal data by EVOCLIC.

10. DISPUTES
The Parties agree to submit the interpretation and execution of this contract to French law, both in terms of rules of form and rules of substance, except for its conflict of laws rules and the Vienna Convention on the International Sale of Goods.
Unless otherwise provided by law, any dispute relating to the conclusion, validity, interpretation, or execution of this contract shall be subject to the exclusive jurisdiction of the courts in the jurisdiction of Metz (France), to which jurisdiction is expressly attributed, notwithstanding multiple defendants or third-party claims, even for emergency or protective procedures, by summary proceedings or application.
